Skeleton racer Katie Olender will miss her sixth Olympic Games after the Court of Arbitration for Sport said she had no jurisdiction to change the outcome of a race that could have helped her qualify for the Milan Cortina Games.
The American slider asked Cass to award her classification points from last month’s race after Canada pulled four athletes from the North American Cup in Lake Placid.
Uhlaender claimed it cost her a place at the Games as she narrowed the field to less than 21, reducing the number of ranking points available for her to qualify.
I appealed to Cas against Bobsleigh Canada Skeleton, Canadian coach Joe Cecchini and the International Bobsleigh and Skeleton Federation (IBSF).
Uhlander, 41, a two-time world champion in 2012, asked for full points to be awarded for the race and questioned whether the decision to withdraw the Canadian athletes “violates the Olympic Movement Code prohibiting tampering with competitions.”
But Cass said in a statement that its ad hoc committee for the Winter Olympics can only hear appeals related to events during the Games or within 10 days of the opening ceremony on February 6.
That means the Jan. 11 race, and the subsequent ruling by FIFA on Jan. 23 that cleared Canada of any wrongdoing, took place before the Jan. 27 deadline.
“The request therefore falls outside the court’s jurisdiction,” she said in a statement.
In their arguments, the International Boxing Federation and Canadian Bobsleigh also said that even if Olander gets the extra points, American officials will have to decide whether to include them.
FIFA had cleared Canada of tampering with qualifications but “recalled” the need to “act within the spirit” of the sports code of ethics.
Bobsleigh Canada Skeleton previously defended the decision, saying it was made after “careful consideration of the athlete’s health, safety and long-term development.”
