The Justice Department has opened a federal civil rights investigation into Alex Peretti’s death, the deputy attorney general said

Homeland Security Secretary Kristi Noem first revealed the shift in which the agency was leading the investigation during an interview with Fox News on Thursday evening. Her department said earlier this week that Homeland Security Investigations, a unit within the department, would head the investigation.

“We will continue to follow the FBI-led investigation and provide them with all the information they need to reach a conclusion, and make sure that the American people know the truth of the situation and how we can move forward and continue to protect the American people,” Noem told Fox host Sean Hannity.

Department of Homeland Security spokeswoman Tricia McLaughlin confirmed Friday that the FBI will lead the Pretty investigation and that HSI will support them. Separately, Customs and Border Protection, part of the Department of Homeland Security, is conducting its own internal investigation into the shooting incident, during which two officers shot Pretty.

DHS did not immediately respond to questions about when or why the change would be made. The FBI did not immediately respond to a request for comment.

It was not immediately clear whether the FBI would now share information and evidence with Minnesota investigators, who have so far been excluded from the federal investigation.

In the same interview, Noem appeared to distance herself from statements she made shortly after the shooting, alleging that Peretti brandished a gun and aggressively approached officers.

Multiple videos that have emerged of the shooting have contradicted that claim, showing the ICU nurse only holding his cellphone in his hand as officers dropped him to the ground, one of whom removed a gun from the back of Pretty’s pants while another officer began shooting him in the back.

Pretty had a state permit to legally carry a concealed firearm. At no point did he appear to reach her, videos showed.

“I know you realize that the situation was very chaotic, and that we were receiving information from the ground from CBP agents and officers who were there,” Noem said during the interview with Hannity on Thursday. “We were using the best information we had at the time, seeking to be transparent with the American people and communicating what we knew to be true on the ground.”

The change comes after two more videos surfaced Wednesday of an earlier altercation between Pretty and federal immigration officers 11 days before his death.

Videos released on January 13 show Pretty wearing a winter coat, screaming at federal vehicles, and at one point appearing to spit before turning off the taillight of one of the vehicles. A struggle ensued between Preeti and several officers, during which he was forced to the ground. He takes off Pretty’s winter coat, and either breaks free or the officers let him go and run away.

When he turns his back to the camera, what appears to be a gun is visible in his waistband. At no point do the videos show Pretty reaching for the gun, and it’s not clear if federal agents saw that.

Steve Schleicher, a Minneapolis-based attorney representing Pretty’s parents, said Wednesday that the earlier altercation in no way justified officers shooting Pretty more than a week later.

In a post on his Truth Social platform early Friday morning, President Donald Trump noted that videos of the earlier incident undermine the narrative that Pretty was a peaceful protester when he was shot.

“The stock of Alex Peretti, the instigator and perhaps insurrectionist, has plummeted with the just released video of him screaming and spitting in the face of a very calm and controlled officer, then madly kicking a brand new and very expensive government vehicle, so hard and violently, in fact, that the tail light broke into pieces,” Trump’s post said. “It was a display of abuse and rage, for all to see, crazy and out of control. The ICE agent was calm and collected, which was not easy to be under those circumstances!”
