WASHINGTON (AP) — The Supreme Court struck down President Donald Trump’s sweeping global tariffs on Friday, handing him a major loss in a case crucial to his economic agenda.

Trump, angry at the defeat, said he would impose a 10% global tariff as an alternative while pressing his trade policies through other means. The new tariffs will come under a law limiting them to 150 days.

He made the announcement after criticizing the Supreme Court for striking down much of the comprehensive tariff infrastructure as an unlawful use of emergency power. Trump said he was “totally ashamed” of the judges who voted to repeal the tariffs, and called the ruling “very disappointing.”
He added: “Their decision is incorrect.” “But that doesn’t matter because we have very strong alternatives.”
Trump calls the ruling “very disappointing”
Trump said he was “absolutely ashamed” of the judges who voted to eliminate the tariffs, calling the decision “very disappointing.”
It is the first major piece of Trump’s broad agenda to go directly before the nation’s highest court, which he helped shape by appointing three conservative jurists in his first term.
Trump called the majority decision a “disgrace” when he was informed during his morning meeting with several state governors, according to a person with direct knowledge of the president’s reaction who spoke on the condition of anonymity to discuss the private conversation.
Trump was meeting privately with nearly two dozen governors from both parties when the decision was issued. The White House did not immediately respond to a request for comment.
Trump thanked Justices Clarence Thomas, Samuel Alito and Brett Kavanaugh “for their strength, wisdom, and love for our country” in dissenting from the majority to support the tariff policies.
Of the more liberal justices who opposed him, Trump said, “You can’t take away their loyalty,” even though he disagreed with their views.
But of the more conservative justices who voted to overturn his tariffs — Chief Justice John Roberts and Justices Amy Coney Barrett and Neil Gorsuch — “they are just idiots and dogs of the RINOs and far-left Democrats,” Trump said.
Without mentioning them by name, Trump referred to the jurists’ actions as “extremely unpatriotic and disloyal to our Constitution.”
Later in the press conference, it was clear that the president was angry with two judges he nominated in his first term who stood against the tariff policy.
“I think this is embarrassing for their families, if you want to know the truth. Both of them,” Trump said of Gorsuch and Barrett.
“Their decision was terrible,” he said.
However, he refused to say whether he regretted nominating them.
Trump says he has ‘great alternatives’
Trump said that “other alternatives will now be used to replace” his sweeping tariffs that were rejected by the Supreme Court.
“We have alternatives,” Trump said. “Great alternatives.”
He said the referee opened the door to let him go “in the direction I probably should have gone the first time.”
Trump also noted that the ruling may not “significantly restrict” tariffs in the future, and mentioned using the Trade Expansion Act and other prior laws, including the Tariff Act of 1930, going forward.
Those alternatives would simply mean a “slightly longer” process, he said.
Trump also mocked his ability to order a complete economic embargo on countries, but without increasing tariffs.
“How ridiculous is this?” he asked.
Trump imposes new tariffs, but they are temporary
In the wake of his defeat in the Supreme Court, the president said he would sign an executive order that would impose a 10% global tariff under a federal law known as Section 122.
The problem is that these tariffs will be limited to only 150 days, unless they are extended legislatively.
The president also said he is exploring other definitions through other avenues, such as Section 232, which would require an investigation through the Commerce Department.
Trump rejects Congress’ role in tariffs
Despite the Supreme Court’s rebuke, the president scoffs at the need to engage Congress in enacting tariff policy.
“You don’t have to,” Trump said when asked why he didn’t just work with lawmakers on tariffs. “I have the right to impose tariffs, and I have always had the right to impose tariffs.”
The majority ruled that Congress has the authority to write tax policy, which includes tariffs.
Trump offers mixed messages about the importance of tariffs
For months, the president has warned that if these tariffs were eliminated, it would be a “disaster” for the country and “literally destroy the United States of America.”
But as he faced questions about governance, Trump repeatedly predicted a sunny future for the United States and rejected the idea that the country would face ruin.
He said the ruling gave “certainty” and said “I think you will see the country become much stronger because of it.”
Trump also said that the alternative paths he would take to try to impose the tariffs, although a much longer process, “would bring us more money. And I think it would be great.”
Trump says his reading prowess is beyond reproach
“Very well read,” Trump said. “Great comprehension.”
The president said that when it came to the tariff issue, “I read everything there was to read. I said, ‘We can’t lose this issue.'”
But the Supreme Court actually ruled against Trump’s sweeping tariff policy — an outcome that Trump suggested was only possible because “the justices want to be political, and they want to be politically correct.”
Trump said the justices who voted in the majority against his tariffs were still “barely” invited to attend the State of the Union address on Tuesday.
But he added, “Honestly, I wouldn’t care much if they came, okay?”
The President delivers the State of the Union address to a joint session of Congress.
But the CEO does not issue invitations to the speech, except to his distinguished guests.
In fact, the Speaker of the House invites the president to deliver the speech in the first place, and while there are always seats reserved for members of the court, Chief Justice John Roberts has previously said that it is up to the individual justices if they want to attend.
Trump concludes his press conference after more than 40 minutes
The President concluded on a positive note, saying that with this ruling, “a great deal of certainty has been restored to the economy of the United States and indeed the economy of the world.”
He repeated one of his favorite phrases, saying that the United States is “the hottest country in the world,” and added: “We’re going to keep it that way.”
